Greyhound Retail Park parking fines: Why shoppers get caught out and how to appeal

Shoppers visiting Greyhound Retail Park in Southend-on-Sea could face an unexpected private parking charge if they leave their car outside one group of shops and walk to another part of the retail park.

The shopping destination off Sutton Road and Greyhound Way has separate parking areas with different restrictions. Parking near Lidl or Iceland and walking to Matalan could therefore result in a charge, even if the motorist later returns to shop where they parked.

Why can walking between shops lead to a parking charge?

Although the businesses appear to form one retail destination, motorists cannot assume that every parking space serves every shop. The Lidl, Iceland and Mecca Bingo area has been treated separately from the Matalan and KFC area.

A restriction against leaving the designated site can apply even when someone shops at a business beside their parked car before or after visiting another section.

The carparks, particularly the one on the Lidl side, are patrolled by staff working for the parking management firms – including UKPC. The staff watch to see shoppers that park in one car park but then cross the road to visit the other side of the retail park.

Who manages the parking at Greyhound Retail Park?

UK Parking Control (UKPC) has been identified with the Lidl and Iceland side, while Parkingeye has been identified with the Matalan and KFC side. These are previously reported arrangements, not independently confirmed current contracts. Check the signs where you park and the company named on any notice, as operators and conditions can change.

Shoppers describe confusion over separate car parks

One shopper reported receiving a UKPC charge after parking near Iceland, briefly visiting Matalan and then shopping at Lidl.

The shopper said the car had been parked for just over an hour and that the notice alleged leaving the designated customer parking site.

Another shopper, Jenny Godfrey, said she had experienced a similar issue and unsuccessfully challenged her charge.

How to avoid a parking charge

  • Read the entrance and on-site signs for the exact section where you park.
  • Check whether leaving the designated site is prohibited.
  • Do not assume shopping at Lidl allows you to walk to Matalan without moving your car, or vice versa.
  • If necessary, move to the appropriate parking area, checking for any no-return rule.
  • Observe maximum stays, marked bays and any vehicle-registration requirements.
  • Keep receipts and take photographs of relevant signs.

How to appeal a Greyhound Retail Park parking charge

A private parking charge notice is different from a council penalty charge. Private parking operators generally rely on contractual terms and civil law. Receiving a notice does not automatically mean it is valid, but a charge should not simply be ignored.

1. Check the notice

Identify the issuing company, alleged breach, date, location, charge amount and appeal deadline. Follow the instructions on the actual notice rather than assuming a particular company operates the site.

2. Gather evidence

Keep receipts, photographs of signs and entrances, records of the visit and any relevant correspondence. If the allegation is leaving the site, ask the operator to identify the site boundary, the precise term breached and the evidence that the driver crossed it.

3. Consider whether signs were clear

Potential grounds for appeal include inadequate signage, an unclear boundary, incorrect facts or insufficient evidence. Being a genuine customer, or walking only a short distance, does not by itself cancel a charge for leaving the designated site.

4. Appeal to the issuing company

Use the procedure and deadline on the notice. UKPC provides an appeals service at ukpcappeals.co.uk; Parkingeye information is available at parkingeye.co.uk. Explain the specific grounds, attach supporting evidence and retain copies. If appealing as the registered keeper, check the legal position before identifying the driver, as keeper liability is subject to statutory conditions.

5. Ask the retailer for help

A store manager may be able to request cancellation for a genuine customer. Provide proof of purchase and ask whether the relevant landlord or managing agent can assist. There is no guarantee of cancellation, and the formal appeal deadline still applies.

What if the appeal is rejected?

The independent appeal route depends on the operator’s accredited trade association. Operators belonging to the British Parking Association use POPLA whereas operators belonging to the International Parking Community use the Independent Appeals Service.

POPLA appeals are normally due within 28 days of rejection, while a free standard IAS appeal normally has a 21-day deadline. Follow the rejection letter and check the current scheme rules.

An unsuccessful appeal does not automatically mean a court would uphold the charge. However, ignoring correspondence can create risks: operators may pursue unpaid charges through civil proceedings. Seek independent advice if the dispute escalates.

Frequently asked questions

Can I park at Lidl and walk to Matalan?

This is usually not allowed due to the car parks being separately managed.

Can I get a charge even if I shopped at Lidl?

Potentially. A purchase at Lidl does not automatically override a clear and enforceable restriction against leaving the designated site.

Can a private parking company enforce a charge?

Private parking charges can be enforceable in civil law, depending on the terms, signage, evidence and applicable legal requirements.

Can I appeal because the shops are only seconds apart?

You can appeal, but proximity alone may not be enough.

Check the signs before leaving your car

The safest approach is to treat Greyhound Retail Park’s parking sections as separate unless the signs clearly say otherwise. If you receive a charge, act within the deadline, preserve evidence and consider the appeal process.

For independent information, see Citizens Advice parking guidance and GOV.UK guidance on challenging parking tickets.

This is general information, not individual legal advice. Parking operators, site arrangements and appeal procedures can change. Always check current signs and the notice itself.

It’s a shame they don’t ask the people openly smoking in the carpark to stop, instead of forcing people to stop walking and keep wasting fuel.
